Pre-orders are orders that are paid for in advance of receiving an item. They are shipped within the timeframe given by the company NOT when the order is placed. Our pre-order period can range between 4-8 weeks from the date in which the order was received. Refunds WILL NOT BE ISSUED for any reason.

If your order was received damaged, we will gladly assess the situation if insurance was purchased at the time.

Please understand the wait time BEFORE placing your order. Refunds will not be issued because the wait time stipulated was not understood by the customer. The wait time will be stipulated on the order confirmation email, the website, and correspondence from the company including social media.

PLEASE READ

We do not tolerate any harassment, slander, libel or hate speech towards Berri-Clear skin or any entity involved with Berri-Clear, in any way shape or form regarding the Company. If an entity/individual chooses to continuously contact and harass the Company via email, text, social media or any other method in any way, we reserve the right to pursue legal action against said entity. We also reserve the right to cancel and refund your order for any reason, including but not limited to the afore-mentioned. We also reserve the right to cancel any subsequent order from an entity or individual who has participated in the afore-mentioned against the company for the duration of the companies lifetime.

Our social media pages, specifically comment sections are not the place for customer service questions or concerns. If harassment or disparaging comments occur on our social media pages especially in comment sections we reserve the right to block the individuals page and report it.

We also reserve the right to pursue legal action against individuals and/or entities who participate in the above mentioned, including but not limited to harassment, slander, libel, via text, email, social media, or in any other method in any way, shape or form.

Our products contain oils and extracts from fruit, as well as active and plant based ingredients. If you have any allergies, including citrus allergies please read the product label carefully. We recommend that people with sensitive skin perform a patch test first to ensure there is no reaction. If irritation occurs, immediately discontinue use.

Berri-Clear Skin's products are made with a combination of naturally derived and laboratory tested and approved ingredients, which in rare cases may cause sensitivity in certain individuals. If sensitivity occurs, immediately discontinue use.

If you are not sure about possible sensitivities, as with all beauty and cosmetic products always do a patch test before use or consult your healthcare professional.

Products and advice by Berri-Clear Skin make no claim to cure, treat or prevent any disease and is not intended to substitute other therapy or medical advice.

Cancellation/Refund Policy

Because our products are custom formulated and we have very strict guidelines in terms of the sanitary environment at our facilities we do not issue refunds nor accept returns. However, i your order was received damaged, we will gladly assess the situation if insurance was purchased at the time.

If you have received a damaged item, we will gladly honor a replacement within 14 days of receipt at no additional shipping charge to you.

The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Berri-Clear Skin agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Termination/Access Restriction

Berri-Clear Skin reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Site. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Berri-Clear Skin as a result of this agreement or use of the Site. Berri-Clear Skin's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Berri-Clear Skin's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Berri-Clear Skin with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
